Terms of Service
The agreement between you and TapIn
These Terms govern your use of TapIn. They are written to be read. The parts a court would care about most — what TapIn is not, what you may not do, and the limits on our liability — are in sections 4, 9, 14 and 15.
1.Agreeing to these Terms
TapIn is an AI-assisted online platform, integrated with trusted service providers, for families going through relationship difficulty, separation or divorce, and for the licensed professionals who help them. It is operated by TapIn Family Law, LLC, a Louisiana limited liability company (“TapIn”, “we”, “us”), and offered at tapinfamily.com and through the TapIn application (together, the “Service”).
By creating an account, accepting an invitation, or using the Service, you agree to these Terms and to our Privacy Policy, which explains how we handle information and is part of this agreement. If you do not agree, do not use the Service. If you use the Service on behalf of a firm or organization, you confirm that you have authority to bind it, and “you” includes it.
2.Who may use TapIn
- You must be at least 18 years old and able to enter a binding contract.
- You must be located in the United States, or using the Service in connection with a matter in the United States.
- If you hold a professional account, you must be, and remain, licensed, certified or otherwise authorized to practice in the field you represent, in good standing, and you must be truthful about it. Holding yourself out as a professional you are not is a breach of these Terms and may be a crime.
- You may not use the Service if we have previously closed your account for breaching these Terms.
3.Accounts
There are two kinds of TapIn accounts:
- Family accounts, for people organizing their own situation and sharing it with professionals they choose. Family accounts are usually created by accepting a professional’s invitation, and may also be created directly.
- Professional accounts, for licensed counselors, mediators, family law attorneys, financial experts and their staff. Professional accounts are organized under a firm or practice and are billed as described in Billing & cancellation.
You are responsible for everything that happens under your account. Keep your sign-in credentials private, turn on multi-factor authentication, and tell us at once at support@tapinfamilylaw.com if you believe your account has been accessed without your permission. Give us accurate information when you register and keep it current. One person, one account; do not share accounts or let anyone else sign in as you.
4.What TapIn is not
TapIn is not a law firm and not a lawyer referral service. It does not provide legal, financial, tax or mental-health advice. Using TapIn does not create an attorney-client relationship, a counselor-client relationship, or any other professional relationship with TapIn. TapIn is not a substitute for an attorney or other qualified professional.
- TapIn is a neutral platform. It represents neither party in any matter and takes no side. The same tools are available to everyone with an account, within the access rules in section 6.
- Professionals are independent. The counselors, mediators, attorneys and financial experts who use TapIn are not our employees, agents or partners. TapIn does not recommend, endorse, vet beyond confirming licensure, or guarantee any professional, and is not responsible for their advice, conduct, fees or work product. Your relationship with a professional is governed by your own agreement with them.
- Information is not advice. Explanations, summaries, calculations, calendars, templates, resource lists and assistant answers in TapIn are general information and organizational tools. They are not advice about your situation. Laws differ by state and change over time; only a licensed professional who knows your facts can tell you what they mean for you.
- Directory listings are not referrals. Where TapIn shows professionals or local services, the listing is informational. We receive no fee for a listing or a match, and a listing is not a recommendation.
If you are in immediate danger, call 911. The National Domestic Violence Hotline is available 24/7 at 1-800-799-7233.
5.Your content and responsibility
Everything you add to TapIn — documents, financial records, notes, messages, calendars, information about your family — is yours (“Your Content”). You keep every right in it. You give us only the limited permission we need to run the Service: to store, process, display, back up and transmit Your Content to the people you have authorized and to the service providers named in our Privacy Policy, for the purpose of providing the Service to you. That permission ends when Your Content is deleted from the Service, except for copies in backups for the period described in the Privacy Policy and copies that others you shared with have already received.
You are responsible for Your Content. You confirm that you have the right to add it and share it as you do; that it does not violate anyone’s rights or any law, court order or confidentiality obligation; and that it is accurate to the best of your knowledge. TapIn does not review Your Content and is not responsible for it. We may remove content that we reasonably believe violates these Terms or the law, and we will tell you if we do unless the law prevents it.
Professionals are responsible for their own professional obligations when using the Service — including client confidentiality, conflicts, record-keeping, supervision of staff, and obtaining whatever consent their rules require before placing a client’s information in TapIn or using AI-assisted features on it. For firms, our Data Processing Addendum, available on request from privacy@tapinfamilylaw.com, sets out our obligations as a processor of client information and forms part of these Terms once signed.
Legal process and records requests. If we receive a subpoena, court order or other legal process for Your Content, we handle it as described in Subpoenas, court orders and records requests: we require valid process, we notify you and any professional with a role on the matter before producing anything unless the law forbids it, we produce only what the process requires, and we treat professional work product as privileged until a court decides otherwise. If you need TapIn to certify its own records of what happened on TapIn — when a document was uploaded, that it has not changed, when an entry was made — see Records certification. Fees apply to both.
6.Invitations and access control
You control who sees what. Access to a matter in TapIn is by invitation and by role. When you invite a professional, you choose what they can see and do; when a professional invites you, they see what you place in the matter they are working on. Nobody has access without a role, and you can review and revoke access at any time from the matter’s sharing settings.
Only invite people you intend to share with. An invitation sent to the wrong address, or access left in place after a relationship ends, is your responsibility to correct. We will act on access changes immediately, but we cannot un-see what someone saw while they had access, and we are not responsible for what an authorized person does with information they were authorized to see.
A professional who leaves a firm, or a firm that closes, may lose access to matters organized under that firm; the family’s own account and Your Content are unaffected.
7.Connected financial accounts
You may choose to connect bank, card, loan or investment accounts to TapIn. Connections are made through Plaid, with your consent, by signing in to your institution inside Plaid’s interface. TapIn never sees or stores your bank login credentials. By connecting an account you authorize TapIn to receive, through Plaid, the account details, balances, transactions, account-holder details and (if you grant it) statements described in our Privacy Policy, and to refresh them while the connection is active. Your use of Plaid is also subject to Plaid’s End User Privacy Policy.
Only connect accounts you are entitled to connect — your own, or accounts you are a lawful owner or authorized user of. Do not connect, or attempt to connect, another person’s account. Information about another party’s finances belongs in TapIn only when it arrives lawfully, for example through discovery or with that person’s consent.
You can disconnect any account at any time from the Account Registry in TapIn or by emailing us. Disconnecting stops future refreshes and deletes the access token; information already imported stays in your matter until you delete it. Connected data is used only to organize your own financial picture inside TapIn and to share it with the professionals you choose.
8.AI-assisted features
Some features of the Service use AI to help read, organize and summarize records, categorize transactions, draft text and answer questions. These features are consent-based: each matter carries an external-AI consent setting, and when it is off, nothing from that matter is sent to an AI provider. The providers, what they receive and the safeguards (masking of sensitive identifiers, no training on your data) are described in the Privacy Policy.
AI output is assistance, not advice, and it can be wrong. It may misread a document, miscategorize a transaction, or state the law incorrectly. You and your professional are responsible for verifying anything an AI feature produces before relying on it, filing it, or sending it to anyone. Financial calculations in TapIn (such as support worksheets) are performed by our own code, not by an AI model, but they still depend on the inputs you provide and should be checked by a professional.
Do not use AI features to generate content that is unlawful, deceptive or harmful, or to attempt to extract the model’s instructions or other users’ information. We may limit AI usage to keep the Service fair and affordable for everyone.
9.Acceptable use
Use TapIn only for its purpose: organizing and working on your own family matter, or the matters of clients you are professionally engaged to help. You agree not to:
- access or attempt to access any account, matter or information you have not been given a role on, or probe, scan or test the vulnerability of the Service without our written permission;
- use the Service to harass, stalk, intimidate, surveil or locate another person, to violate a protective order, or to obtain information about another person that you are not lawfully entitled to;
- upload malware, interfere with the Service, or impose an unreasonable load on it;
- impersonate anyone, misrepresent your role, licensure or authority, or create accounts for others without their knowledge;
- use the Service to give legal, financial or mental-health advice if you are not licensed to do so, or to practice law in a jurisdiction where you are not admitted;
- use the Service for any unlawful purpose or in violation of any court order;
- scrape, crawl, spider, harvest or bulk-download any part of the Service or its content by any automated means, or circumvent any technical measure that limits access;
- benchmark, reverse engineer, decompile or disassemble the Service, or attempt to discover its source code, models, prompts, rules, algorithms, data structures or underlying ideas, except to the extent a law expressly permits it despite this restriction;
- perform competitive analysis of the Service, publish performance or feature comparisons of it, or use any part of it to build, train, improve or market a competing product or service — including using the Service’s outputs, structure or workflows to develop another product;
- copy, resell, sublicense, rent, lease, or make the Service available to third parties other than the people you invite as these Terms allow; or
- remove or alter any proprietary notice in the Service.
We may investigate suspected violations, limit or suspend access while we do, and report unlawful activity to law enforcement.
10.Public records and regulated data
Professional accounts may use features that search public records, court dockets and identity databases through third-party providers. Some of those providers supply information regulated by the Gramm-Leach-Bliley Act (GLBA), the Driver’s Privacy Protection Act (DPPA) and similar laws, which allow access only for specific permissible purposes.
Each time a professional uses such a feature, the professional certifies that the search is made for a permissible purpose under those laws — namely use in connection with a civil, criminal, administrative or arbitral proceeding in which the professional or the professional’s client is involved, or in preparation for one — and for no other purpose. These features may never be used for employment, credit, insurance, tenant screening or any other purpose regulated by the Fair Credit Reporting Act; TapIn is not a consumer reporting agency and its results are not consumer reports. The professional is responsible for the lawfulness of each search and for keeping the records their own rules require, and must not use results to harass, locate or contact a person in violation of any law or order. We log these searches and may suspend access for misuse.
Family accounts do not have access to these features.
11.Fees and billing
Professional accounts are paid subscriptions. Prices, trials, billing cycles, cancellation, refunds and failed payments are described in Billing & cancellation, which is part of these Terms. Family accounts are paid by the family member who holds them (a trial, a one‑time matter fee, and an optional yearly co‑parenting plan), whether they joined directly or by a professional’s invitation; a family is never billed for a professional’s seat. Any fees a professional charges you for their services are between you and them.
12.Our rights in TapIn
The Service — its software, design, text, templates, workflows, data models, documentation and the TapIn name and logo — belongs to TapIn Family Law, LLC or its licensors and is protected by copyright, trademark, trade-secret and patent law. TapIn is patent pending. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. We reserve all other rights.
Templates and generated documents are tools; the content you put in them is Your Content. If you send us suggestions, you agree that we may use them without obligation to you.
13.Termination
By you. You may close your account at any time by emailing support@tapinfamilylaw.com (or through account settings where available). Paid subscriptions are cancelled as described in Billing & cancellation.
By us. We may suspend or close your account if you breach these Terms, if your professional licensure lapses or is misrepresented, if your subscription goes unpaid after the grace period, if required by law, or if continuing to provide the Service to you would create a risk to other users or to us. Except where the breach is serious or the law requires otherwise, we will give you notice and a reasonable chance to fix the problem first.
What happens next. When an account closes, your access ends. Your Content is retained and then deleted as described in the Privacy Policy, and you may request a copy before deletion. Content you shared with others remains with them. Sections that by their nature should survive — including 5, 9, 12 and 14 through 20 — survive termination.
14.Disclaimers
Some states do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, sections 14 through 16 apply to the fullest extent the law allows, and nothing in them limits liability for intentional misconduct or gross negligence, or any right that your state's consumer-protection law does not allow to be waived.THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, TAPIN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT DEFECTS WILL BE CORRECTED, THAT ANY INFORMATION, CALCULATION, TEMPLATE OR AI OUTPUT WILL BE ACCURATE, COMPLETE OR CURRENT, OR THAT THE SERVICE WILL MEET YOUR NEEDS OR THE REQUIREMENTS OF ANY COURT.
TAPIN IS NOT RESPONSIBLE FOR THE ADVICE, CONDUCT OR WORK OF ANY PROFESSIONAL, FOR THE ACCURACY OF INFORMATION SUPPLIED BY FINANCIAL INSTITUTIONS, DATA PROVIDERS OR PUBLIC-RECORD SOURCES, OR FOR THE ACTS OF ANY PERSON YOU GRANT ACCESS TO. NOTHING IN THE SERVICE IS LEGAL, FINANCIAL, TAX OR MENTAL-HEALTH ADVICE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
15.Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TAPIN FAMILY LAW, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL OR OPPORTUNITY, OR FOR ANY OUTCOME IN A LEGAL PROCEEDING, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO TAPIN IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY FOR OUR FRAUD, GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
16.Your responsibility for claims
If a third party brings a claim against TapIn because of Your Content, your breach of these Terms, your violation of a law or of someone’s rights, or — for professionals — your professional services or your use of the public-records features, you agree to defend us against the claim and to pay the damages, costs and reasonable attorneys’ fees that result. We will tell you promptly about any such claim and cooperate with your defense, and we may participate with our own counsel at our expense.
17.Governing law and venue
These Terms, and any dispute arising out of or related to them or the Service, are governed by the laws of the State of Louisiana and applicable federal law, without regard to conflict-of-laws rules. Subject to section 18, you agree that any court proceeding will be brought exclusively in the state or federal courts located inAscension Parish, Louisiana, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking an injunction or other urgent relief in any court with jurisdiction, or limits consumer-protection rights that the law of your state of residence gives you and does not allow to be waived.
18.Dispute resolution
Before starting any formal proceeding, you agree to email a description of the dispute to support@tapinfamilylaw.com and to work with us in good faith for 30 days to resolve it informally. Most problems are resolved this way.
Before either of us files a claim, we agree to try to resolve the dispute informally. You can send a written description of the dispute to privacy@tapinfamilylaw.com; we will send ours to the email address on your account. Each of us will have 30 days from that notice to respond and to try in good faith to resolve the dispute. If it is not resolved within those 30 days, it will be decided by the courts named in section 17. Either of us may bring a qualifying claim in small-claims court instead.
19.Changes to these Terms
We may update these Terms as the Service and the law change. The date at the top tells you when. For material changes we will give you at least 30 days’ notice by email or in the app before they take effect; continuing to use the Service after that date means you accept them. If you do not accept a change, close your account before it takes effect. Changes required by law may take effect sooner.
20.General terms
- Entire agreement. These Terms, the Privacy Policy, the Billing & cancellation page and, for a firm that has signed it, the Data Processing Addendum are the whole agreement between you and TapIn about the Service and replace any earlier agreement. A separate written agreement between TapIn and a firm controls over these Terms where they conflict.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect and the unenforceable part is read as narrowly as needed to make it enforceable.
- No waiver. If we do not enforce a provision, we may still enforce it later.
- Assignment. You may not transfer your account or these Terms to anyone else. We may assign them to a successor to our business, with notice to you.
- Notices. We will send notices to the email address on your account. Send notices to us at support@tapinfamilylaw.com or by mail to the address below.
- Force majeure. We are not responsible for delays or failures caused by events outside our reasonable control, including outages at service providers, internet failures, natural disasters or government action.
- Export and sanctions. You confirm that you are not barred from using U.S. services under any sanctions or export law.
- Relationship. We are independent contractors; nothing here creates a partnership, agency or employment relationship between you and TapIn, or between TapIn and any professional.
